Introduction
The Northern Territory's Long Service Leave Act 2018 offers a hybrid scheme: a classic 10-year entitlement plus a linear accrual and generous pro-rata triggers from year seven onward. This guide explains the calculations, employer obligations, and how our calculator handles various employment patterns.
Key figures
- 8.6667 weeks after 10 years.
- Further accrual at 0.8667 weeks for every extra year.
- Pro-rata payable between 7–10 years if employment ends due to illness, incapacity, domestic necessity, or employer-initiated termination.
Taking and directing leave
The NT allows employees and employers to agree to single-day absences. Employers may direct leave with three months' notice, but at least four weeks must be taken. Public holidays add an extra paid day.
Ordinary pay rules
Payment is whichever is higher: the ordinary pay for the last pay period before leave, or the average ordinary pay for the last five years. Casuals average hours across 12 months or five years. Commission-only staff average the better of 12 months or five years' earnings.

Example scenarios
Resignation at 8 years 6 months for domestic necessity
- Weeks: 8.5 × 0.8667 = 7.367.
- Hours: 7.367 × 38 = 279.9 hours.
Continuous service 17 years full-time
- Weeks: 8.667 + (7 × 0.8667) = 14.734 weeks.
- Hours: 14.734 × 38 = 559.9 hours.
Compliance note: Remember that casual loading is included in the ordinary rate of pay for LSL calculations.
