Introduction

Victoria rewrote its Long Service Leave Act in 2018. The new model is more flexible than its predecessor and remains the only regime that expressly allows leave at half pay. Below you will find the legislative essentials, payroll rules, and practical examples to plug into our online calculator.

Core entitlement

  • 6.0667 weeks after seven years.
  • Continuous accrual thereafter at 0.8667 weeks per year.

Continuous employment rules

Victoria treats unpaid leave up to 52 weeks as service. Anything above a year can still count if employer and employee agree in writing or if the absence is illness or injury. Service is also preserved when an employee is re-hired within 12 weeks of termination or the expiry of a fixed-term contract.

Accessing leave

An employee may apply for LSL once they reach the seven-year threshold. Requests must give reasonable notice, and employers can refuse only on reasonable business grounds. Leave can be taken at half pay, effectively doubling its length, if both sides agree.

Direction to take leave

Employers may require staff to commence LSL with 12 weeks' written notice if the balance exceeds the statutory minimum.

Public holidays

Public holidays falling during LSL add an extra paid day.

Pro-rata payout

The entire balance becomes money if service ends at or beyond seven years, irrespective of cause. No payout below seven years except by court order, so resignations at 6 years 11 months yield nothing.

Example scenarios

Employee with 8 years service

  • Weeks: 8 × 0.8667 = 6.9336 weeks.
  • Hours: 6.9336 × 38 = 263.5 hours.

Employee with 15 years service

  • Weeks: 15 × 0.8667 = 13.0005 weeks.
  • Hours: 13.0005 × 38 = 494.0 hours.

Compliance note: Remember that casual loading is included in the ordinary rate of pay for LSL calculations.
